📱 Welcome to DayKeeper! These Terms of Service govern your use of the DayKeeper application. By downloading, installing, or using DayKeeper, you agree to be bound by these terms.
By accessing or using DayKeeper ("the App", "our App", "the Service"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you ("User", "you", or "your") and TechArtisan, the developer of DayKeeper ("we", "us", or "our").
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use DayKeeper on your personal device solely for your personal, non-commercial use.

All data you create, input, or store in DayKeeper (including events, dates, notes, and images) remains your property. We do not claim any ownership rights to your personal data.
DayKeeper stores all your data locally on your device. We do not have access to your data, and it is not transmitted to our servers unless you explicitly choose to use cloud storage services for backup or synchronization.
You are solely responsible for backing up your data. We recommend regularly exporting your data using the App's backup feature. We are not responsible for any data loss that may occur.
⚠️ Currently Not Available: Cloud synchronization features are not currently supported in DayKeeper. The app operates entirely offline with all data stored locally on your device. If cloud sync functionality is added in future updates, it will be governed by the terms outlined below.
Should we introduce third-party cloud storage integration (such as iCloud Drive, Google Drive, Dropbox, OneDrive) in the future, the following terms will apply:
Use of cloud storage services would be entirely optional. The App will continue to function fully without cloud synchronization.

"DayKeeper" and related logos are trademarks or registered trademarks. You may not use these marks without our prior written permission.
Any content you create within the App (events, notes, images) remains your property. By using the share feature, you grant us a limited license to display and process your content solely for the purpose of providing the sharing functionality.
DayKeeper is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

While we strive for accuracy in date calculations and milestone tracking, we do not warrant that all calculations will be error-free. You are responsible for verifying important dates and information.
⚠️ Important: To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of DayKeeper.

In jurisdictions that do not allow the exclusion or limitation of liability, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability exceed the amount you paid for the App (if any).
We may release updates, upgrades, or new versions of DayKeeper from time to time. These updates may include new features, bug fixes, or security improvements. You are encouraged to keep the App updated to the latest version.
We reserve the right to modify these Terms at any time. We will notify you of material changes by:

You may stop using DayKeeper at any time by uninstalling the App from your device. You may also delete all your data within the App before uninstalling.
We reserve the right to suspend or terminate your access to DayKeeper at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the App shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved in accordance with the laws of the applicable jurisdiction.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of DayKeeper and supersede all prior agreements and understandings.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
